Environmental Liability Insurance

Environmental Liability, based mainly on Law 26/2007, is the unlimited liability that obliges to prevent with urgent measures the damage to natural resources and, if the damage occurs, to repair the natural resources to return them to their original state.

The law requires an "Analysis of environmental risks ( ARMA) as a previous step to the determination of the financial guarantee or insurance ( according to RD 2090/2008 of December 22 and order APM(1040/2017 of October 23), and subsequently the requirement of such guarantee or compulsory insurance to be subscribed by the companies attached to the list of companies included in Annex III of the law, and whose entry into force is next 16/10/2021.

  • The owner of any economic or professional activity, whatever it may be, must assume the totality of the costs incurred by these preventive or remedial actions.
  • It is an administrative liability (required by the public administration) and additional to civil liability.
